Marbury V. Madison

SSCG16: The Student will demonstrate knowledge of the operation of the federal judiciary.

They had decided that Marbury did indeed have a right to his commission. This was also the first time the Supreme Court had declared and act of congress unconstitutional. They decided that the Judiciary Act of 1789 was unconstitutional.

In the end, this court case was stepping stone to all of the ones to come later. It would establish Judicial Review, which would be used in ever court case to come. Judicial Review is the ability that the Supreme Court has to decide the constitutionality of a legislation.

1st Period American Governent

It is argued to be the most important court case, and it establish the set rules for the court cases to come. In the final days of Adams' presidency, he had appointed a large number of Supreme Court Justices. He had the letters written out, signed, and ready to be sent. However, once his days of presidency were over, those letters were never sent. During the next presidency, James Madison was ordered to not deliver the commissions to any of the appointed justices.

The current chief justice at that time was: John Marshall.
