Tipologia de Sentencias

The first division between continents was made by ancient Greek navigators, who named them 'landmass, terra firma'.

Generally classified by convention rather than any strict criteria, nowadays seven regions are regarded as continents from a geopolitical point of view.

Sentencia de Principio

Asia is the world's largest continent of the seven continents in size, as it covers one-third of the earth's surface.

It includes 50 countries, and it is the most populated continent, 60% of the total population of the Earth lives here.

Son las sentencias que forman la jurisprudencia propiamente dicha, es decir cubren lagunas legales, generan o modifican un procedente vinculante. Por otro lado, el TC dicto que se llamen “instructivas”, debido a que este tipo de sentencias tienen como objetivo orientar a los jueces.

Sentencias Destimativas

Son aquellas cuando el órgano de control constitucional considera variables conceptuales que se utilizara para analizar y resolver una controversia constitucional.

Sentencias Exhortativas

Es cuando el órgano de control constitucional declara la incompatibilidad constitucional de forma parcial o total de una ley, el cual en un plazo razonable se expide una ley sustitutoria con contenido acorde a las normas y principios.

Sentencias Sustitutivas

Es cuando el órgano del control constitucional declara la inconstitucionalidad parcial de una ley y, simultáneamente reemplaza el contenido normativo.

Sentencias Aditivas

Son aquellas cuando el órgano de control constitucional determina la existencia de una inconstitucionalidad por omisión, en la cual se añade contenido al texto incompleto y transformarlo en constitucional.

Sentencias Reductoras

Son cuando se restringe o se declara su inconstitucionalidad por una parte del texto cuestionado “frase, palabra, líneas, inciso, etc.”

Reconstructiva

Consiste en agregar el contenido que no aparece en la ley impugnada.

Ablativa

Consiste en reducir lo alcances normativo de la ley eliminada, el cual es declarado nulo sus expresiones impertinentes

Son cuando el órgano de control constitucional declara la inconstitucionalidad la interpretación errónea emitida por algún operador judicial, estableciendo que en el futuro lo operadores jurídico estarán prohibidos de interpretar y aplicar su interpretación contraria a la constitución.

Es cuando el órgano de control constitucional deja sin efecto a una ley o norma con rango de ley, estas pueden ser de forma parcial “un artículo, un párrafo, inciso, etc.” Y de forma total “desaparición del texto normativo”.
