Manifestation Determination: is the students behaviors caused by their disability?

If yes, the student cannot be given long term suspension or expulsion from the school
If no, the student is able to receive any discipline outlined in the schools code of conduct, although educational services will be provided wherever the student is placed

If an out of school suspension is over 10 days...

The school, parents, and IEP team hold a Manifestation Determination to determine if behaviors are cause by disabiltiy or not
An FBA is given to create a BIP
Educational Services are provided to the student at their home
The IEP team meets to determine what services will be provided during out of school suspension

The student is subject to the schools disciplinary code

The student receives in school suspension and is monitored using in school discipline
The student receives out of school suspension

The student displays a disruptive behavior that violates school disciplinary code

The student is monitored and data is collected about the students typical behavior
i.e. The student sexually harasses another classmate
i.e. The student brings a gun to school
