The Consumer Credit Act 1974 requires most businesses that offer goods or services on credit or lend money to consumers to be licensed by the OFT. Trading without a licensing arrangement is a criminal offence and can result in a fine and/or imprisonment.

Some agencies still offer credit and could therefore be affected by the law.

supply of goods act

Under the Sale of Goods Act 1979 and The Supply of Goods and Services Act 1982 traders must sell goods that are as described and of satisfactory quality, and provide services that are to a proper standard of workmanship.

The services provided by a guest house must be of a proper standard

Trade descriptions act

This Act has offered protection to consumers and legitimate traders for over three decades. It is an extremely versatile piece of legislation which has been used to tackle all manner of different forms of unfair trading

The Act also makes it a criminal offence:

to make a statement which is known to be false or misleading

recklessly to make a statement which is false or misleading as to any of the following matters:

the provision of services accommodation or facilities

the nature of any services, accommodation or facilities provided

the time at which, manner in which or persons by whom any services, accommodation or facilities so provided

the examination, approval or evaluation by any person of any services, accommodation or facilities so provided

the location or amenities of any accommodation so provided

sale of goods act

This is the main piece of legislation protecting consumers when things go wrong.

It would provide the customer with protection if their holiday did not come up to standard.
